FISA provides intelligence organizations with guidelines to lawful surveillance for the purpose of gathering international intelligence, allowing them to apply for and justify operations AFTER the fact. With the passage of the Patriot Act, surveillance for reasons of potentila criminal prosecution were added to FISA guidelines.
